CLEARLAKE TOWNSHIP E-LERT TERMS OF SERVICE AND DISCLAIMER
The Clearlake Township ("Township") provides text messaging services on a best efforts basis in response to such emergency events as severe storms and tornados, snow emergencies, water boil orders, amber alerts, major street closings and the like (the "Services") to any person who subscribes to the Services through this website ("Subscriber").

Examples of Possible Problems: The Township provides warnings to Subscribers as to emergency events via text messaging as soon as the Township's server receives the information. Due to problems inherent in providing text messaging information, especially during emergency conditions, the Township cannot guarantee the accuracy, reliability or availability of the Services. There may be a delay during the time that the information is received and recorded. There may also be delays between the time that the server sends the information and receipt thereof by the Subscriber's service provider and delivery thereof to the Subscriber. In the event of a computer network system crash, power failure, weather conditions or similar events, the Township may not be able to provide warnings or update information in a timely fashion. There may also be human error in inputting the data which may affect the accuracy of the information provided. Subscribers may be unable to receive text messaging in some geographical areas due to the unavailability of service by their service providers.

Possible Charges: While the Township does not itself charge for the Services, Subscribers may be charged by their service providers for providing the text messaging service.

ACCORDINGLY, THE TOWNSHIP DISCLAIMS ALL WARRANTIES, PROMISES AND REPRSENTATIONS, EXPRESS OR IMPLIED, REGARDING THE SERVICES, INCLUDING BUT NOT LIMITED TO THE RELIABILITY, TIMELINESS, OR AVAILABILITY TO THE SUBSCRIBER OF INFORMATION PROVIDED. SUBSCRIBER HEREBY AGREES THAT SUBSCRIBER'S USE OF THE SERVICES IS SUBJECT TO THE FOREGOING DISCLAIMER, AND IS AT SUBSCRIBER'S SOLE RISK AND EXPENSE. SUBSCRIBER HEREBY RELEASES THE TOWNSHIP FROM ALL CLAIMS AND LIABILITY WITH RESPECT TO THE SERVICES OR SUBSCRIBER'S USE OF THEREOF. ANY RETRANSMISSION BY SUBSCRIBER OF INFORMATION PROVIDED BY THE SERVICES TO A THIRD PARTY IS ALSO SUBJECT TO THE FOREGOING DISCLAIMER, IS AT THE SUBSCRIBER'S AND THIRD PARTY'S SOLE RISK, AND IS SUBJECT TO THE FOREGOING RELEASE. SUBSCRIBER IS SOLELY LIABLE FOR ALL CHARGES TO SUBSCRIBER BY ANY TEXT MESSAGING SERVICE PROVIDER OR OTHERWISE, RESULTING FROM SUBSCRIBER'S USE OF THE SYSTEM.
